Washington DC—The UFCW applauds Congressional efforts to force the Occupational Safety and Health Administration (OSHA) to regulate Diacetyl—a dangerous chemical that has killed at least three workers and injured hundreds of others. Today, U.S. Rep. Lynn Woolsey (D-CA) introduced H.R. 2693, a bill which would compel OSHA to issue a standard regulating worker exposure to this deadly chemical.
Diacetyl is a chemical used to impart the flavor of butter in popcorn, pastries, frozen foods, and candy. Each day that they report to work, tens of thousands of food processing workers are exposed to Diacetyl—a dangerous chemical that has been connected to a potentially fatal lung disease. There have been dozens of cases of what has become known as “popcorn workers lung,” or bronchiolitis obliterans—a severe, disabling, and often-fatal lung disease experienced by food industry workers across the nation.
Despite compelling evidence that Diacetyl presents a grave danger and significant risk of life threatening illness to employees exposed to the chemical, there are currently no OSHA standards requiring exposures to be controlled.
Last year, The UFCW, together with the International Brotherhood of Teamsters, petitioned the Department of Labor (DOL) to issue an Emergency Temporary Standard to stop the continued risk of Diacetyl exposure to workers. Forty-two of the nation’s leading occupational safety scientists signed on to an accompanying letter agreeing that there is more than enough evidence for OSHA to regulate this dangerous chemical. Still, OSHA did not act.
“OSHA has been sitting on evidence that there is a direct correlation between Diacetyl and popcorn workers lung for years. By not regulating this dangerous chemical, OSHA has neglected its responsibility to food workers,” said Jackie Nowell, UFCW Safety & Health Director. “The idea that it would take an act of Congress to get OSHA to do its job and protect workers is appalling.”

Petition California Occupational Safety and Health Standards Board for Emergency Temporary Standard for the Chemical
(Buena Park, California) – On August 23, 2006 the United Food and Commercial Workers’ Union, Western States Council and the California Labor Federation petitioned the California Occupational Safety and Health Standards Board to immediately issue an Emergency Temporary Standard for diacetyl, a deadly chemical used in flavorings. This follows action taken on July 26, 2006, when two affiliate unions of the Change to Win federation – the United Food and Commercial Workers International Union (UFCW) and the International Brotherhood of Teamsters -petitioned the Department of Labor (DOL) for an Emergency Temporary Standard for diacetyl under Occupational Safety and Health Act.
Diacetyl is a hazardous chemical that has been connected to a potentially fatal lung disease that has been experienced by food industry workers across the nation. There have been dozens of cases of what has become known as “”popcorn workers lung,”” or bronchiolitis obliterans-a severe, disabling, and often-fatal lung disease experienced by factory workers who produce or handle diacetyl. Several food industry employees in California have developed devastating lung problems after being exposed to diacetyl in the workplace. There are currently no OSHA standards requiring exposures to diacetyl and flavorings be controlled.
According to the Division of Occupational Safety and Health, there are 16 – 20 plants producing flavorings in the state of California. And thousands of food processing workers are involved in the production of popcorn, pastries, frozen foods, candies and even dog food that use these chemicals.
The petition was accompanied by a letter from forty-two of the nation’s leading occupational safety scientists, including a former OSHA director, five former top officials from OSHA, the Environmental Protection Agency, and the Department of Health and Human Services, who all agree that there is more than enough evidence for OSHA to regulate.
The UFCW and the California Labor Federation are petitioning the Standards Board to require employers to control airborne exposure to diacetyl and ensure that all employees who are exposed to a certain airborne level of the chemical are provided with air purifying respirators. The safety of these workers would be additionally monitored through medical surveillance and regular consultations.
The petition also demands that Cal/OSHA immediately issue a bulletin to all employers and employees potentially exposed to diacetyl outlining the dangers of the chemical. Cal/OSHA is being asked to conduct inspections and begin rule-making proceedings to establish a permanent standard that will put an end to this tragic epidemic and protect workers from exposure to all flavorings.

(Washington, DC) —On July 26, 2006, two affiliate unions of the Change to Win federation — the United Food and Commercial Workers International Union (UFCW) and the International Brotherhood of Teamsters — began petitioning the Department of Labor (DOL) to immediately issue an Emergency Temporary Standard to stop the continued risk of diacetyl exposure to workers. In 2002 and 2003, OSHA’s own scientists studying diacetyl unsuccessfully urged their leaders to take broader action to protect workers. There are currently no OSHA standards requiring exposures to be controlled.

More than 8,000 workers are employed in the flavorings production industry and may be exposed to the dangers of diacetyl and other similar chemicals. Tens of thousands of food processing workers are involved in the production of popcorn, pastries, frozen foods, candies and even dog food that use these chemicals. It is not clear whether consumers are at risk from exposure to diacetyl but certainly the workers who deal with high concentrations of the flavoring chemical are at risk of developing serious and irreversible lung damage.
The unions’ petition is accompanied by a letter from forty-two of the nation’s leading occupational safety scientists, including a former OSHA director, five former top officials from OSHA, the Environmental Protection Agency, and the Department of Health and Human Services, who all agree that there is more than enough evidence for OSHA to regulate.

An Emergency Standard is necessary to prevent the suffering and death of the additional workers who will get sick during the time it would take for OSHA to set a Permanent Standard.”

Today, the 1.4 million member United Food and Commercial Workers International Union (UFCW) unveils a massive display in the heart of the nation’s capital marking the daily body count of Americans killed and wounded in Iraq. These are the sons and daughters of working America who are making the sacrifice at the call of their government. The UFCW— a voice for working America— will never forget the sacrifice of our service men and women, their courage and commitment, and the grief of their families.
For the families of those who have fallen, we mourn your loss. For those who have been crippled and maimed in the service of their country, we honor your heroism and support you in your struggle.
We have placed a display here at the corner of K St. NW and 18th St. NW in Washington D.C. Every day we will update the count of American losses in Iraq so that corporate lobbyists and the foreign policy think tanks that dominate the canyons of K St. NW as well as the leaders around the corner at the White House and up the hill in Congress will always remember the impact of the policies that they advocate and the decisions that they make.
In Washington, the war in Iraq may be a matter of policy and politics. In working America, the war in Iraq is a matter of life and death, human sacrifice and suffering.
The UFCW will never forget. We want to make sure that those in power never forget either.
(Approximately 40 UFCW members have been killed in Iraq. Untold hundreds of immediate family members and relatives of UFCW members have been killed or wounded in Iraq.)

Gephardt Health Care Stance Wins Support From
Nation’s Largest Private Sector Union
Davenport, Iowa—Today, the nation’s largest private sector union, and the largest union in Iowa, put the support of its 1.4 million members behind Dick Gephardt for President. The United Food and Commercial Workers International Union endorsed the Gephardt campaign based on his plan to protect the employer-based health care system in the U.S.
The UFCW is at the forefront of the fight to protect health care at work for millions of working families. This weekend, UFCW is leading more than 70,000 supermarket employees on strike in Southern California to fight back against employer demands to destroy health benefits for workers and their families. In the meatpacking industry, UFCW members have been on strike since February 28, 2003, at Tyson Foods in Jefferson, Wisconsin, to stop Tyson from slashing health care for the 470 workers. In St. Louis, Missouri, 10,000 retail food workers are on the picket line fighting back against a similar employer demand that would threaten workers’ medical benefits.
“Most Americans get health care at work, and we want to keep it that way because the UFCW believes if you do the work, you’ve earned affordable health care,” said UFCW International Secretary-Treasurer Joe Hansen.
“If you have medical benefits at work, the Gephardt plan will make sure you keep them and that they stay affordable,” continued Hansen. “If you work, but don’t get benefits, the Gephardt plan will make sure you do.”
The endorsement was based on UFCW members’ views on working family issues in the context of the 2004 presidential election.
Research, conducted by the Wilson Center for Public Research, shows that UFCW members feel the government should take action to deal with:
· Rapidly rising health care costs (94%)
· 44 million Americans without health insurance (91%)
· Employer demands for cuts in medical benefits (87%)
In addition, 97% of those polled felt that a candidate’s position on protecting health care at work was important—75% said it was crucial—to making a decision about their choice for President in 2004.
These perceptions reflect the views of the cashier moms, a key demographic in next year’s election. UFCW membership mirrors the general workforce population in every category—gender, race, age, and marital status, making UFCW member views a snapshot of those held by millions of working people around the country.

The future looks much sweeter for the 330 Domino Sugar workers in Baltimore, Md. The United Food and Commercial Workers Union (UFCW) Local 392 members ratified a new three-year contract on Saturday, January 11, 2003, that ends the 35-day strike.
Workers fought back against company demands to alter their retirement plan, take away two paid holidays and increase health insurance costs. The new contract:
Protects the workers’ pension plan by maintaining current benefits and protecting the investments;
Preserves the two paid holidays, Veteran’s Day and New Year’s Eve, that the company pushed to eliminate;
Provides 2% wage increases for all workers; and
Improves the health care plan.
Over the past 35 days, none of the 330 workers crossed the picket line.
“”The Domino Sugar workers stood on the front line against corporate greed and they won,”” said Mark Lauritsen, UFCW International Vice President and Regional Director. “”Their solidarity gives hope to all working families across the country who deserve fair and decent wages and benefits for the hard work they do every day.””
Workers traveled around the country in “”Truth Squads”” to rally support for their strike from sugar workers in New York, Florida and Georgia. The Baltimore community supported workers by honoring their boycott message and by making donations to the hardship fund for workers’ families.
UFCW Local 392 President Alex Hamilton said, “”I want to thank everyone who supported us in this struggle for a fair contract. Without the generous donations of the good people of Baltimore and our UFCW brothers and sisters, our fight would have been more difficult our spirits lower.””

Workers at the nation’s largest natural food supermarket chain are building a movement for a voice on the job with the United Food and Commercial Workers International Union. Workers at the store in Tyson’s Corner, Virginia, filed for Labor Board election to join UFCW Local 400 on January 31, 2003. The election date has not been set.
Workers in Madison, Wisconsin kick-started the national movement by voting for UFCW Local 1444 representation on July 15, 2002. Despite Whole Foods’ stall tactics, the workers continue to bargain with them and are working toward reaching a first contract.
The Madison campaign leaders launched a website, www.wholeworkersunite.org where workers from the 142 Whole Foods stores can connect with each other and learn about taking action for a better workplace.
“”Whole Foods workers across the country saw the Madison workers stand up and realized that they could take action to make their workplace better, too. The movement is growing,”” said xxxxxx
The campaign is building momentum around the country, with Whole Foods workers connecting via the website and email to learn more about organizing for a real voice on the job.
